Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Ondaform Labs LLC, a limited liability company organized under the laws of the State of Wyoming, USA ("Ondaform", "we", "us"), and govern your access to and use of the Gojan website, applications and services (the "Service"). By creating an account, subscribing or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.

1. Eligibility & acceptance

You must be at least 18 years old (or the age of majority where you live, whichever is higher) to use the Service. The Service is not directed to minors under 18. By creating an account, you represent that you are 18 or older. If we find that a user is under 18, we will close their account. The account and payment-method holder must have legal capacity to enter into a contract.

2. The Service

Gojan is an AI-assisted personal training service. Through a conversational AI, you receive personalized workout routines that adapt to your goals, available equipment and physical limitations. We also offer integrable modules for gyms and trainers to embed these features into their own applications (B2B). The Service may change, add or remove features over time.

3. Health & AI disclaimer

• Not medical advice. Gojan provides general fitness information and routines; it is not a substitute for the advice of a physician, physiotherapist or other qualified health professional. Consult a professional before beginning any exercise program, especially if you have a medical condition, injury or are pregnant. You use the routines at your own risk, and results are not guaranteed.
• AI-generated content. Routines and coach responses are generated automatically by artificial-intelligence models and may contain errors. Use your judgment and stop any exercise that causes pain or discomfort.

4. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly at team@gojan.app of any unauthorized use.

5. Acceptable use

You agree not to: (a) violate any law or third-party right; (b) copy, modify, decompile, reverse-engineer or create derivative works of the Service except as permitted by law; (c) resell, sublicense or commercially exploit the Service without our authorization; (d) upload malware, scrape data without authorization, or interfere with the security, integrity or performance of the Service; (e) use the Service or its output to train third-party models; or (f) use the Service to harass, harm or infringe others.

6. Subscriptions, billing & auto-renewal

• Paid plans. Certain features require a paid subscription or other plan described at purchase. Prices, billing frequency and features are shown before you buy, in the applicable currency, and may include taxes where required.
• Payment processing. Payments are processed by Stripe and, where you purchase through a mobile app store, by Apple or Google. We do not store full card numbers.
• Automatic renewal. Unless stated otherwise, subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. By subscribing you authorize these recurring charges.
• Cancellation. You may cancel at any time through your account settings (or your Apple/Google account) or by emailing team@gojan.app. Cancellation stops future renewals and takes effect at the end of the current period.
• Price & plan changes. We may change prices or plans with reasonable prior notice; changes apply to the next billing period.
• Free trials. If a free trial is offered, unless you cancel before it ends it will convert to a paid subscription at the disclosed price.
• Refunds. Refunds are governed by our Refund Policy.

7. Intellectual property

The Service — including its software, the "Gojan" name and marks, logos, designs, text, content and generated routines — is owned by Ondaform Labs LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, revocable, non-exclusive and non-transferable license to use the Service in accordance with these Terms. Your content remains yours; you grant us a worldwide, royalty-free license to host, process and use it to operate, secure and improve the Service. If you send us feedback, we may use it without obligation to you.

8. Third-party services & app stores

The Service integrates third-party services (e.g., Stripe, Supabase, Google, AI providers) and may be distributed via the Apple App Store or Google Play. Your use of those services is subject to their own terms, and app-store purchases are additionally subject to the store's billing and refund rules. We are not responsible for third-party services.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Ondaform and its members, officers and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or for personal injury arising from your use of the Service. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or USD 100. Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Ondaform Labs LLC and its members, officers and suppliers from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms or of any law, or your infringement of any third-party right.

12. Suspension & termination

We may suspend or terminate your access if you breach these Terms or where necessary for legal or security reasons. You may stop using the Service and delete your account at any time. Sections that by their nature should survive (e.g., IP, disclaimers, liability, indemnification, dispute resolution) survive termination.

13. Dispute resolution & governing law

• Talk to us first. Before filing any claim, please contact us at team@gojan.app; we resolve most issues quickly and informally.
• Governing law. These Terms and any dispute are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Wyoming — except that this does not deprive you, as a consumer, of the protection of the mandatory consumer-protection laws of your country of residence, which continue to apply.

14. Changes to these Terms

We may update these Terms; we will post the current version with its effective date and, for material changes, make reasonable efforts to notify you. Continued use after changes take effect means you accept them.

15. General

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect (severability). Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). You consent to receive communications electronically.
